These terms are an agreement between you and Author Growth Management ("we," "us," "our"). They cover your use of this website and any application you send us through it. By using the site, you agree to them. If you do not agree, please do not use the site.
This site describes a done-for-you publishing partnership for romance authors and lets you apply for it. It is information and an invitation to apply. It is not an offer, and nothing on it creates a partnership, employment relationship, joint venture, or agency between us.
Sending us an application does not obligate either of us to anything. We may accept or decline any application for any lawful reason, or for no reason, and we do not have to tell you why. A partnership starts only when both sides sign a separate written agreement. That signed agreement, not this website, controls the terms of any work, pay, rights, credit, and pen name arrangements.
You keep ownership of the writing samples and other material you send us. By sending them, you give us permission to read, copy, store, and share them internally to evaluate your application.
Please do not send us anything confidential, anything you do not have the right to share, or anything covered by another company's exclusivity or non-compete agreement. Do not send us ideas you expect to be paid for on the strength of the submission alone. We work with many writers and see similar material often, so we cannot agree to keep submissions secret or to hold back from developing similar stories on our own. If a submission is not covered by a signed agreement between us, we may delete it at any time.
You confirm that what you tell us is true, that the writing you send is your own original work, that it does not infringe anyone's rights, and that you have not hidden from us how it was produced.
Anything on this site about earnings, sales, rankings, revenue, or timelines describes what has happened for particular books or authors under particular conditions. It is an illustration, not a promise, projection, or guarantee of what you will earn or achieve. Publishing results depend on the market, on advertising costs and platform rules that we do not control, on the quality and volume of the writing, and on many other factors. You are responsible for your own business and tax decisions. We do not give legal, tax, or financial advice.
Do not use this site to break the law. Do not submit false information or impersonate anyone. Do not scrape, crawl, or harvest the site by automated means beyond ordinary search engine indexing. Do not try to break, overload, or gain unauthorized access to the site or the systems behind it. Do not upload malware. Do not copy, resell, or republish the site's content, design, or copy without our written permission.
The site, including its text, layout, graphics, and design, belongs to us or our licensors and is protected by copyright and trademark law. Our names, logos, and brand marks are ours. You are welcome to view the site and share links to it. You may not use our content or marks for your own commercial purposes without written permission.
This site links to third parties, including Amazon and Kindle Direct Publishing. We do not control them, we are not responsible for them, and a link is not an endorsement. Your use of those platforms is governed by their own terms.
If you give us your email address, you agree that we may contact you about your application. If you sign up for updates, you can unsubscribe at any time using the link in the email.
We may change, suspend, or discontinue any part of the site at any time, and we may update these terms. If we update them, we will change the effective date above, and continuing to use the site after that means you accept the change. The site is offered as-is and may be unavailable for maintenance or for reasons outside our control.
To the fullest extent the law allows, the site is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the site will be uninterrupted, secure, accurate, or error-free.
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or lost business opportunity, arising out of or relating to the site or these terms, even if we were warned such damages were possible. Our total liability for any claim relating to the site or these terms will not exceed one hundred US dollars ($100). Some places do not allow all of these limits, so parts of this section may not apply to you.
You agree to defend, indemnify, and hold us harmless from claims, damages, losses, and reasonable legal fees arising out of your use of the site, the material you send us, or your breach of these terms.
These terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Any dispute relating to the site or these terms will be brought only in the state or federal courts located in the State of Texas, and you and we both consent to the jurisdiction of those courts. Each of us waives any right to a jury trial, and neither of us will bring or take part in a class action about the site.
If any provision here is found unenforceable, the rest stays in force. If we do not enforce a provision, that is not a waiver of it. You may not assign these terms; we may assign them to a successor in a sale or reorganization. These terms and our Privacy Policy are the entire agreement between us about this website. If you and we sign a partnership agreement, that agreement controls wherever it conflicts with these terms.
